Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on February 10, 2003, in
response to a petition filed on behalf of workers of Lapp Insulator
Company LLC, Substation Division, LeRoy, New York. The workers
produced high voltage ceramic insulators for power substations such
as station posts and special porcelain - housings.
The investigation revealed that station posts and special
porcelain - housings accounted for most of the subject facility's
sales and production in January-November 2002.
Sales, production and production worker employment decreased
in January-November 2002 compared to the same period in 2001.
U.S. imports of electrical insulators of ceramics increased in
2002 compared to 2001.
The Department conducted a survey of the major customers of
the subject firm regarding their purchases of station posts in
January-November 2001 and January-November 2002. The survey
revealed that a respondent increased its purchases of imported
station posts while decreasing its purchases of station posts from
the subject facility in the relevant period.
The Department conducted a survey of the major customers of
the subject firm regarding their purchases of special porcelain -
housings in January-November 2001 and January-November 2002. The
survey revealed that respondents increased their purchases of
imported special porcelain - housings while decreasing their
purchases of special porcelain - housings from the subject facility
in the relevant period.
The Department conducted a bid survey of major awards on
station posts projects lost by the subject firm in the relevant
period. The survey revealed that an award on which the subject
firm was the lowest bidder was awarded to a domestic firm
manufacturing the products in China.
Conclusion
After careful review of the facts obtained in the
investigation, I conclude that increases of imports of articles
like or directly competitive with station posts and special
porcelain - housing produced at Lapp Insulator Company LLC,
Substation Division, LeRoy, New York contributed importantly to the
total or partial separation of workers and to the decline in sales
or production at that firm or subdivision. In accordance with the
provisions of the Act, I make the following certification:
"All workers of Lapp Insulator Company LLC, Substation
Division, LeRoy, New York who became totally or partially
separated from employment on or after November 7, 2001 through
two years from the date of certification are eligible to apply
for adjustment assistance under Section 223 of the Trade Act
of 1974, as amended."
