Certification Regarding Eligibility to Apply for
Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19 USC
2273), as amended, the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance as a secondarily affected
worker group.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance,
the group eligibility requirements under Section 222(b) must be
met. It has been determined in this case that the requirements of
Section 222(b) are met.
The investigation was initiated on January 28, 2003 in
response to a petition filed by a company official on behalf of
workers of F/V Aaron and Eric, State of Alaska Commercial Fisheries
Entry Commission Permit # 60027H, Manokotak, Alaska. The workers
of the subject group produce fresh and chilled salmon.
From 2001 to 2002 sales and employment of the subject group
decreased absolutely.
The investigation revealed that Fishing Vessel (F/V) Aaron and
Eric, Manokotak, Alaska, is an upstream supplier of fresh and
chilled salmon to a processor whose workers were certified eligible
to apply for trade adjustment assistance based on increased
customer imports and who accounted for at least 20 percent of the
sales of the subject group.
Conclusion
After careful review of the facts obtained in the
investigation, I conclude that increases in imports of processed
salmon, contributed importantly to the total or partial separation
of Fishing Vessel (F/V) Aaron and Eric, State of Alaska Commercial
Fisheries Entry Commission Permit # 60027H, Manokotak, Alaska.
In accordance with the provisions of the Act, I make the
following certification:
"All workers of Fishing Vessel (F/V) Aaron and Eric, State of
Alaska Commercial Fisheries Entry Commission Permit # 60027H,
Manokotak, Alaska, who became totally or partially separated
from employment on or after January 21, 2002, through two
years from the date of certification are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974."
