Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents
the results of its investigation regarding certification of
eligibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either
paragraph (a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act
must be met. It is determined in this case that the requirements
of (a)(2)(A) of Section 222 have been met.
The investigation was initiated on January 13, 2003 in
response to a petition filed by a company official on behalf of
the workers of Wards Cove Packing Company, Seattle, Washington
(TA-W-50,542), Wards Cove Packing Company, Alitak Cannery,
Alitak, Alaska (TA-W-50,542A), Wards Cove Packing Company, Ekuk
Cannery, Dillingham, Alaska (TA-W-50,542B), Wards Cove Packing
Company, Excursion Inlet Plant Cannery, Excursion Inlet, Alaska
(TA-W-50,542C), Wards Cove Packing Company, Red Salmon Cannery,
Naknek, Alaska (TA-W-50,542D), Wards Cove Packing Company, South
Naknek, Alaska (TA-W-50,542E), Wards Cove Packing Company, Wards
Cove Cannery, Ketchikan, Alaska (TA-W-50,542F), E. C. Phillips &
Son, a subsidiary of Wards Cove Packing Company, Ketchikan,
Alaska (TA-W-50,542G), Wards Cove Packing Company, Resurrection
Bay Seafoods, Seward, Alaska (TA-W-50,542H), Wards Cove Packing
Company, Egegik Fish Camp, Egegik, Alaska (TA-W-50,542I), E. C.
Phillips & Son, Craig Operations, a subsidiary of Wards Cove
Packing Company, Ketchikan, Alaska (TA-W-50,542J), and Wards
Cove Packing Company, Haines Fish Camp, Haines, Alaska (TA-W-
50,542K). Workers at Wards Cove Packing Company, Seattle,
Washington (TA-W-50,542) support activities at all other
facilities. Workers at Wards Cove Packing Company, Alitak
Cannery, Alitak, Alaska (TA-W-50,542A) produced frozen herring,
cod, halibut, and salmon; canned salmon; and salmon roe and
salmon caviar. Workers at Wards Cove Packing Company, Ekuk
Cannery, Dillingham, Alaska (TA-W-50,542B) produced frozen
herring, frozen salmon, canned salmon, salted roe, and unsalted
salmon sides. Workers at Wards Cove Packing Company, Excursion
Inlet Plant Cannery, Excursion Inlet, Alaska (TA-W-50,542C)
produced fresh, frozen, and canned salmon; salted salmon roe;
salmon caviar; halibut; and sablefish. Workers at Wards Cove
Packing Company, South Naknek, Alaska (TA-W-50,542E) produced
frozen herring, frozen salmon, salted salmon roe, and salted
salmon sides. Workers at Wards Cove Packing Company, Wards Cove
Cannery, Ketchikan, Alaska (TA-W-50,542F) produced canned salmon
and salmon caviar. Workers at E. C. Phillips & Son, a
subsidiary of Wards Cove Packing Company, Ketchikan, Alaska (TA-
W-50,542G) produced fresh and frozen salmon, halibut, sablefish,
rockfish, shrimp, sea cucumbers, geoducks, salmon caviar, and
herring. Workers at Wards Cove Packing Company, Resurrection
Bay Seafoods, Seward, Alaska (TA-W-50,542H) produced fresh and
frozen halibut, Pacific cod, sablefish, and rockfish. Workers
at Wards Cove Packing Company, Egegik Fish Camp, Egegik, Alaska
supported fishermen for Wards Cove Packing Company, Red Salmon
Cannery, Naknek, Alaska (TA-W-50,542D). Workers at E. C.
Phillips & Son, Craig Operations, a subsidiary of Wards Cove
Packing Company, Ketchikan, Alaska (TA-W-50,542J) bought seafood
from fisherman and did some limited processing. Workers at
Wards Cove Packing Company, Haines Fish Camp, Haines, Alaska
(TA-W-50,542K) supported fishermen at Wards Cove Packing
Company, Excursion Inlet Plant Cannery, Excursion Inlet, Alaska
(TA-W-50,542C).
The investigation revealed that sales, production, and
employment at the subject firm declined from 2001 to 2002.
The Department of Labor surveyed the subject firm's major
customers regarding their purchases of fresh, frozen, and canned
salmon. The survey revealed increases in imports of fresh,
frozen, and canned salmon during the relevant time period.
Conclusion
After careful review of the facts obtained in the
investigation, I conclude that increases of imports of articles
like or directly competitive with those produced at the subject
firm contributed importantly to the decline in sales or
production and to the total or partial separation of workers of
that firm. In accordance with the provisions of the Act, I make
the following certification:

Alitak Cannery, Alitak, Alaska (TA-W-50,542A), Wards Cove
Packing Company, Ekuk Cannery, Dillingham, Alaska (TA-W-
50,542B), Wards Cove Packing Company, Excursion Inlet Plant
Cannery, Excursion Inlet, Alaska (TA-W-50,542C), Wards Cove
Packing Company, Red Salmon Cannery, Naknek, Alaska (TA-W-
50,542D), Wards Cove Packing Company, South Naknek, Alaska
(TA-W-50,542E), Wards Cove Packing Company, Wards Cove
Cannery, Ketchikan, Alaska (TA-W-50,542F), E. C. Phillips &
Son, a subsidiary of Wards Cove Packing Company, Ketchikan,
Alaska (TA-W-50,542G), Wards Cove Packing Company,
Resurrection Bay Seafoods, Seward, Alaska (TA-W-50,542H),
Wards Cove Packing Company, Egegik Fish Camp, Egegik,
Alaska (TA-W-50,542I), E. C. Phillips & Son, Craig
Operations, a subsidiary of Wards Cove Packing Company,
Ketchikan, Alaska (TA-W-50,542J), and Wards Cove Packing
Company, Haines Fish Camp, Haines, Alaska (TA-W-50,542K)
who became totally or partially separated from employment
on or after January 10, 2002, through two years from the
date of certification are eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974."
