Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (19 USC 2273), the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(B) of
Section 222 have been met.
The investigation was initiated in response to a petition
received on December 19, 2002 and filed by the Maine State
Workforce Agency on behalf of workers at Clorox Products
Manufacturing Company, a wholly owned subsidiary of The Clorox
Company, Londonderry, New Hampshire. The workers produced mixing
materials (resin and carbon) and provided resin cleaning.
The investigation revealed that the subject firm also used
workers of Kelly Services at the plant to produce the mixing
materials (resin and carbon) and resin cleaning.
The investigation revealed that production and employment
declined from 2000 to 2001, and again from January to November 2002
when compared to the same time period in 2001. Furthermore, the
investigation revealed a shift in production from the subject firm
to Canada during the relevant period.
Conclusion
After careful review of the facts obtained in the
investigation, I conclude that a shift in production from the
workers firm to Canada of articles that are like or directly
competitive with the mixing materials (resin and carbon) produced
by Clorox Manufacturing Company, Londonderry, New Hampshire,
contributed to the total or partial separation of workers of that
firm.


In accordance with the provisions of the Act, I make the
following certification.
"All workers of Clorox Products Manufacturing Company, a
wholly owned subsidiary of The Clorox Company, Londonderry,
New Hampshire, and leased workers of Kelly Services engaged in
the production of the mixing materials (resin and carbon) and
resin cleaning at Clorox Products Manufacturing Company, a
wholly owned subsidiary of The Clorox Company, Londonderry,
New Hampshire, who became totally or partially separated from
employment on or after December 17, 2001 through two years
from the date of certification are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974, as amended."
