Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (19 USC 2273), the Department of Labor herein presents
the results of an investigation regarding certification of
eligibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either
paragraph (a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act
must be met. It is determined in this case that the requirements
of (a)(2)(A) of Section 222 have been met.
The investigation was initiated in response to a petition
received on December 12, 2002 and filed by the International
Association of Machinists and Aerospace Workers, District Lodge
No. 165, on behalf of workers at SPX Corporation, Valves and
Controls Division, Sartell, Minnesota.
Workers in the both the foundry and the final production
factory are/were engaged in an integrated process related to the
production of industrial valves.
The investigation revealed that the foundry portion of the
subject company closed in 2002. A significant number of workers
in both areas of the firm were separated.
Sales and production at the subject firm declined during
the relevant time period.
The investigation also revealed increased company imports
of valves during the relevant time period.
A previous Trade Adjustment Assistance petition filed on
behalf of the workers at SPX Corporation, Valves and Controls
Division, Sartell, Minnesota was terminated, TA-W-42,214 (signed
December 5, 2002).
Conclusion
After careful review of the facts obtained in the
investigation, I conclude that there was an increase of imports
of articles that are like or directly competitive with those
produced by the subject firm or subdivision. In accordance with
the provisions of the Act, I make the following certification:




"All workers of SPX Corporation, Valves and Controls
Division, Sartell, Minnesota, in the foundry and the
production factory, who became totally or partially
separated from employment on or after November 15, 2001
through two years from the date of certification are
eligible to apply for adjustment assistance under Section
223 of the Trade Act of 1974, as amended."
