Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents
the results of its investigation regarding certification of
eligibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either
paragraph (a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act
must be met. It is determined in this case that the requirements
of (a)(2)(A) of Section 222 have been met.
The investigation was initiated in response to a petition

received on December 9, 2002 and filed on behalf of workers at

The Holmes Group, Rival Division, Clinton, Missouri, TA-W-50,280

and 50,280A, The Holmes Group, Rival Division, Kansas City,

Missouri, TA-W-50,280B; The Holmes Group, Rival Division,

Jackson, Mississippi, TA-W-50,280C and The Holmes Group, Rival

Division, Sweet Springs, Missouri, TA-W-50,280D. The affected

workers at the Golden Drive facility in Clinton, Missouri

(50,280) produced small slow cookers, ice cream makers, fans,

and humidifiers. The affected workers at the South Orchard

facility in Clinton, Missouri (50,280A) produced ice cream

makers. The affected workers at the Jackson, Mississippi

facility (50,280C) produced slow cookers and workers at the

Sweet Springs, Missouri facility (50,280D) produced electric

heaters and slow cookers. Workers at the Kansas City, Missouri

facility did not produce a product, rather served as

administrative support for the production facilities in Clinton,

and Sweet Springs, Missouri and Jackson, Mississippi.

The workers per location are not separately identifiable by

product line.

The investigation revealed that from 2000-2001 and January
to November 2001-2002, production at the subject facilities
decreased.
The investigation further revealed that company-wide
imports of slow cookers, ice cream makers, fans and humidifiers
increased during this period under investigation.
Conclusion
After careful review of the facts obtained in the
investigation, I conclude that increases of imports of articles
like or directly competitive with slow cookers, ice cream
makers, fans and humidifiers produced at The Holmes Group, Rival
Division, Clinton, Missouri, TA-W-50,280 and 50,280A, The Holmes
Group, Rival Division, Kansas City, Missouri, TA-W-50,280B; The
Holmes Group, Rival Division, Jackson, Mississippi, TA-W-50,280C
and The Holmes Group, Rival Division, Sweet Springs, Missouri,
TA-W-50,280D, contributed importantly to the total or partial
separation of workers and to the decline in sales or production
at that firm or subdivision. In accordance with the provisions
of the Act, I make the following certification:

"All workers of The Holmes Group, Rival Division, Clinton,
Missouri, TA-W-50,280 and 50,280A, The Holmes Group, Rival
Division, Kansas City, Missouri, TA-W-50,280B; The Holmes
Group, Rival Division, Jackson, Mississippi, TA-W-50,280C
and The Holmes Group, Rival Division, Sweet Springs,
Missouri, TA-W-50,280D, who became totally or partially
separated from employment on or after December 9, 2001
through two years from the date of certification are
eligible to apply for adjustment assistance under Section
223 of the Trade Act of 1974, as amended."
