Certification Regarding Eligibility to Apply for
Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19 USC
2273), as amended, the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance as a secondarily affected
worker group.
In order to make an affirmative determination and issue a
certification of eligibility for secondary workers to apply for
Trade Adjustment Assistance, the group eligibility requirements of
paragraph (a)(2)(C) of Section 222 of the Trade Act, as amended,
must be met. It is determined in this case that the requirements of
(a)(2)(C) of Section 222, as amended, have been met.
The investigation was initiated on November 20, 2002 in
response to a petition filed on behalf of workers of TSCO/Tube
Specialties Co., Inc., Troutdale, Oregon. The workers produce
specialized tubes and pipes for manufacturers of medium and heavy-
duty trucks.



The investigation revealed that TSCO/Tube Specialties Co.,
Inc., Troutdale, Oregon produces specialized tubes and pipes
which it supplies to a manufacturer of medium and heavy-duty
trucks, and a loss of business with this manufacturer contributed
importantly to the workers separation or threat of separation.
Evidence revealed that Freightliner LLC, Portland, Oregon,
to which the petitioning workers' firm supplies specialized tubes
and pipes, employed a group of workers who received a
certification of eligibility for adjustment assistance, and such
supply or production is related to the article that was the basis
for such certification. Freightliner LLC shifted production
abroad while reducing purchases of specialized tubes and pipes
from the petitioning workers' firm. The subject firm's
employment declined, in part, because of the shift in production.
Workers of Freightliner LLC, Portland, Oregon were certified as
eligible to apply for NAFTA Transitional Adjustment Assistance on
November 19, 2002 (NAFTA #4636).
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of TSCO/Tube Specialties
Co., Inc., Troutdale, Oregon qualify as adversely affected
secondary workers under Section 222 of the Trade Act of 1974, as
amended. In accordance with the provisions of the Act, I make the
following certification:



"All workers of TSCO/Tube Specialties Co., Inc., Troutdale,
Oregon who became totally or partially separated from
employment on or after November 20, 2001, through two years
from the date of certification are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974, as amended"
