Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance on December
4, 2002, applicable to workers of Bike Athletic Company, Cutting
Department, Knoxville, Tennessee. The notice was published in
the Federal Register on December 23, 2002 (67 FR 78256).
The Union of Needletrades, Industrial and Textile Employees,
Tennessee/Kentucky requested that the Department expand the
certification to include all workers of the subject firm. The
Department reviewed the certification for workers of the subject
firm. The findings show that the Department issued certification
coverage to all workers of the subject firm's Cutting Department.
The investigation conducted for the subject firm was on
behalf of workers manufacturing (cut fabric) men's and women's
athletic team apparel. The investigation revealed that company
imports of men's and women's athletic team apparel increased
while production and employment declined during the period of the
investigation, thus impacting all workers of the subject firm.

It is the intent of the Department to include all workers of
Bike Athletic Company adversely affected by increased imports.
Therefore, the Department is amending the certification
determination to correctly identify the worker group to read all
workers.
The amended notice applicable to TA-W-50,167 is hereby
issued as follows:
"All workers of Bike Athletic Company, Knoxville, Tennessee
who became totally or partially separated from employment on
or after November 21, 2001, through December 4, 2004, are
eligible to apply for adjustment assistance under Section
223 of the Trade Act of 1974."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated in response to a petition
received on November 22, 2002 and filed by the Union of
Needletrades, Industrial and Textile Employees, Tennessee/Kentucky
District on behalf of workers at Bike Athletic Company, Cutting
Department, Knoxville, Tennessee. The workers were engaged in the
manufacturing (cut fabric) of men's and women's athletic team
apparel.
The investigation revealed that company sales and production
of men's and women's athletic team apparel decreased during the
relevant period. Employment at the Cutting Department decreased in
2001 compared to 2000 and in January through September 2002
compared to the same period in 2001.
Company imports increased in January through September 2002
compared to the same period in 2001.
The company transferred a significant percentage of sewing
production, as well as the equivalent cutting work from the subject
facility, to South Africa and the Dominican Republic. In addition,
a shift in production of the remainder of the cutting work at the
subject facility to Mexico is currently underway. This shift in
production will be completed by the end of 2002.
Conclusion
After careful review of the facts obtained in the
investigation, I conclude that increases of imports of articles
like or directly competitive with men's and women's athletic team
apparel produced at Bike Athletic Company, Cutting Department,
Knoxville, Tennessee contributed importantly to the total or
partial separation of workers and to the decline in sales or
production and at that firm or subdivision. In accordance with the
provisions of the Act, I make the following certification:


"All workers of Bike Athletic Company, Cutting Department,
Knoxville, Tennessee who became totally or partially separated
from employment on or after November 21, 2001 through two
years from the date of certification are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974, as amended."
