Certification Regarding Eligibility to Apply for
Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19 USC
2273), as amended, the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance as a secondarily affected
worker group.
In order to make an affirmative determination and issue a
certification of eligibility for secondary workers to apply for
Trade Adjustment Assistance, the group eligibility requirements of
paragraph (a)(2)(C) of Section 222 of the Trade Act, as amended,
must be met. It is determined in this case that the requirements of
(a)(2)(C) of Section 222, as amended, have been met.
The investigation was initiated on November 5, 2002, in
response to a petition filed on behalf of two groups of workers
of Vulcan Chemicals. One worker group produced chloroform at
Vulcan's plant in Wichita, Kansas; a second worker group produced
R-22 refrigerant at an unaffiliated company, Atofina Chemicals,
also of Wichita, Kansas.
The investigation revealed that the first group of workers
of Vulcan Chemicals produced chloroform which was supplied to
Atofina Chemicals in Wichita, a manufacturer of R-22 refrigerant.
A loss of business with Atofina Chemicals contributed importantly
to the worker separations at Vulcan. The workforce of Atofina
was certified, in its entirety, as eligible to apply for trade
adjustment assistance benefits on August 21, 2002 (TA-W-41,620).
The second worker group was employed by Vulcan Chemicals but
worked at the Atofina Chemicals facility producing R-22
refrigerant. The cause of those worker separations is identical
to that revealed by the investigation that resulted in the
determination of eligibility for workers of Atofina Chemicals
noted above.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Vulcan Chemicals,
Wichita, Kansas engaged in the production of chloroform qualify as
adversely affected secondary workers under Section 222 of the Trade
Act of 1974, as amended. In accordance with the provisions of the
Act, I make the following certification:
"All workers of Vulcan Chemicals, Wichita, Kansas engaged in
the production of chloroform who became totally or partially
separated from employment on or after November 4, 2001,
through two years from the date of certification are eligible
to apply for adjustment assistance under Section 223 of the
Trade Act of 1974, as amended"
"All workers employed by Vulcan Chemicals, Wichita, Kansas
engaged in the production of R-22 refrigerant at Atofina
Chemicals, Wichita, Kansas who became totally or partially
separated from employment on or after November 4, 2001,
through two years from the date of certification are eligible
to apply for adjustment assistance under Section 223 of the
Trade Act of 1974, as amended"
