Notice of Determinations Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of
eligibility to apply for worker adjustment assistance.
The investigation was initiated on November 1, 2002 in
response to a petition filed by United Steelworkers of America,
Local 7139 on behalf of workers at Allegheny Ludlum, Washington
Plate Division, a subsidiary of Allegheny Technologies, Washington,
Pennsylvania (TA-W-42,359); Allegheny Ludlum, Flat Roll Division, a
subsidiary of Allegheny Technologies, Washington, Pennsylvania
(TA-W-42,359A); and Allegheny Ludlum, Melt Shop and Rolling Mill
Division, a subsidiary of Allegheny Technologies, Houston,
Pennsylvania (TA-W-42,359B). The workers at Allegheny Ludlum,
Washington Plate Division, a subsidiary of Allegheny Technologies,
Washington, Pennsylvania (TA-W-42,359) produce stainless plate,
nickel alloy plate, tool steel plate, and titanium plates. The
workers at Allegheny Ludlum, Melt Shop and Rolling Mill Division, a
subsidiary of Allegheny Technologies, Houston, Pennsylvania (TA-W-
42,359B) produce hot rolling coils. The workers at Allegheny
Ludlum, Flat Roll Division, a subsidiary of Allegheny Technologies,
Washington, Pennsylvania (TA-W-42,359A) produced stainless plate,
nickel alloy plate, tool steel plate, and titanium plates; however,
production at the plant did not take place for over a year.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance,
each of the group eligibility requirements of Section 222 of the
Act must be met:
(1) that a significant number or proportion of the workers in
the workers' firm, or an appropriate subdivision thereof,
have become totally or partially separated, or are
threatened to become totally or partially separated;

(2) that sales or production, or both, of the firm or
subdivision have decreased absolutely; and

(3) that increases of imports of articles like or directly
competitive with articles produced by the firm or
appropriate subdivision have contributed importantly to
the separations, or threat thereof, and to the absolute
decline in sales or production.

It has been determined with respect to workers at Allegheny
Ludlum, Washington Plate Division, a subsidiary of Allegheny
Technologies, Washington, Pennsylvania (TA-W-42,359) that all of
the criteria have been met. The investigation revealed that
production and employment at Allegheny Ludlum, Washington Plate
Division, a subsidiary of Allegheny Technologies, Washington,
Pennsylvania (TA-W-42,359) declined absolutely from 2000 to 2001.
Furthermore, the Department of Labor surveyed the subject
facility's major customers regarding their purchases of stainless
plate, nickel alloy plate, tool steel plate, and titanium plates.
This survey revealed increases in imports of stainless plate,
nickel alloy plate, tool steel plate, and titanium plates during
the relevant period.
It has been determined with respect to workers at Allegheny
Ludlum, Flat Roll Division, a subsidiary of Allegheny Technologies,
Washington, Pennsylvania (TA-W-42,359A) that production at the
facility did not take place for over a year. Section 223(b)(1) of
the Trade Act of 1974, as amended, provides that a certification
may not apply to a worker whose separation from employment occurred
more than one year prior to the date the petition was filed.
It has been determined with respect to workers at Allegheny
Ludlum, Melt Shop and Rolling Mill Division, a subsidiary of
Allegheny Technologies, Houston, Pennsylvania (TA-W-42,359B) that
criterion (3) has not been met.


The investigation revealed that Allegheny Ludlum, Melt Shop
and Rolling Mill Division, a subsidiary of Allegheny Technologies,
Houston, Pennsylvania (TA-W-42,359B) did not import hot rolling
coils during 2000, 2001, or 2002.
A Department of Labor survey of the subject facility's
customers revealed no imports of hot rolling coils during the
relevant period.
Conclusion
After careful review of the facts obtained in the
investigation, I conclude that increases of imports of articles
like or directly competitive with those produced at Allegheny
Ludlum, Washington Plate Division, a subsidiary of Allegheny
Technologies, Washington, Pennsylvania (TA-W-42,359) contributed
importantly to the decline in sales or production and to the total
or partial separation of workers of that firm. In accordance with
the provisions of the Act, I make the following certification:
"All workers of Allegheny Ludlum, Washington Plate Division, a
subsidiary of Allegheny Technologies, Washington, Pennsylvania
(TA-W-42,359), who became totally or partially separated from
employment on or after November 1, 2001, through two years
from the date of certification are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974."
"After careful review, I determine that all workers at
Allegheny Ludlum, Flat Roll Division, a subsidiary of
Allegheny Technologies, Washington, Pennsylvania (TA-W-
42,359A) are denied eligibility to apply for adjustment
assistance under Section 223 of the Trade Act of 1974."
"After careful review, I determine that all workers at
Allegheny Ludlum, Melt Shop and Rolling Mill Division, a
subsidiary of Allegheny Technologies, Houston, Pennsylvania
(TA-W-42,359B) are denied eligibility to apply for adjustment
assistance under Section 223 of the Trade Act of 1974."
