Subject: Workforce Innovation and Opportunity Act (WIOA) Core Program Performance Accountability Assessment for Program Year (PY) 2023
Purpose: Consistent with Joint WIOA Final Rule requirements, the U.S. Departments of Labor and Education (the Departments) have determined it is appropriate and reasonable in PY 2023 for the:
- U.S. Department of Labor (DOL) to assess performance for four performance indicators under the WIOA title I core programs and for three performance indicators under the Employment Service (referred to as “WIOA title III”) core program;
- U.S. Department of Education (ED) to assess performance for four performance indicators under the Vocational Rehabilitation (referred to as “WIOA title IV”) core program; and
- Departments to delay assessing performance for the purpose of imposing sanctions for the WIOA title II core program and for the remaining performance indicators in the WIOA titles I, III, and IV core programs to provide for the orderly transition from the requirements of the Workforce Investment Act of 1998 (WIA) to those of WIOA, as permitted under section 503(a) of WIOA.

TEN No. 19-22, Change 1 provides clarification and alignment of the reporting of training types in the Participant Individual Record Layout (PIRL) and promotes consistent and reliable data analysis across the DOL’s employment and training programs.

Purpose: This guidance provides information to grant recipients of the U.S. Department of Labor workforce programs, including states, and provides guidelines for grant recipients to use in developing procedures for ensuring the data submitted for performance reporting are valid and reliable.

Subject: Performance Accountability Guidance for Workforce Innovation and Opportunity Act (WIOA) Core Programs
Purpose: This guidance updates Training and Employment Guidance Letter (TEGL) 10-16, Change 1, published August 23, 2017, and developed jointly by the U.S. Departments of Labor (DOL) and Education (ED) (the Departments). Within ED, the Office of Career, Technical, and Adult Education (OCTAE) will update Program Memorandum (PM) 17-2 and the Rehabilitation Services Administration (RSA) will update Technical Assistance Circular (TAC) 17-01 to be consistent with the changes reflected herein. With this issuance, the Departments update the guidance to reflect changes made to the information collection request (OMB Control No. 1205-0526) after August 23, 2017, and incorporate other changes to improve clarity of the guidance.

Purpose: This Training and Employment Guidance Letter (TEGL) conveys to states the Administration's priorities, modification requirements, submission process, and deadline for the required modification of the WIOA Unified and Combined State Plans (State Plans) for PY 2022 and PY 2023, consistent with Sections 102 and 103 of WIOA.

Purpose: The U.S. Departments of Labor and Education (the Departments) have determined it is appropriate and reasonable for the Department of Labor (DOL) to begin assessing performance for two performance indicators under WIOA title I and III core programs for PYs 2020 and 2021 in accordance with the phased-in approach to performance assessments described in Training and Employment Guidance Letter (TEGL) 11-19, Negotiations and Sanctions Guidance for the Workforce Innovation and Opportunity Act (WIOA) Core Programs. The Departments, as permitted under section 503(a) of WIOA, have determined it reasonable to delay assessing performance for the purpose of imposing sanctions for the remaining performance indicators to ensure an orderly transition from the requirements of the Workforce Investment Act of 1998 (WIA) to those of WIOA.

ETA anticipates launching the website in December 2020. This notice provides information to states and eligible training providers about their requirements and responsibilities to comply with the Workforce Innovation and Opportunity Act (WIOA) statute.

Subject: Negotiations and Sanctions Guidance for the Workforce Innovation and Opportunity Act (WIOA) Core Programs
Purpose: Through this guidance, the U.S. Departments of Labor and Education (Departments) delineate the process for negotiating levels of performance, as required by section 116(b)(3)(A)(iv) of the Workforce Innovation and Opportunity Act (WIOA). This guidance also provides explanation of the two instances in which a state may be sanctioned for performance failure or for failure to report (section 116(f) of WIOA). Section 116 of WIOA, its implementing regulations, and this guidance govern how the Departments will determine when it is necessary to sanction a state, which is statutorily required by WIOA.

Purpose: To provide guidance to WIOA state grantees regarding the content of the WIOA Annual Statewide Performance Report Narrative for titles I and III and the procedures for submission to the Employment and Training Administration (ETA). The report is due annually on December 1, or the first business day thereafter should that date fall on a weekend. The PY 2017 report is due December 3, 2018.

Purpose: To provide guidance to states on performance reporting on ETPs. Under WIOA, all states must collect and report performance information on all individuals and WIOA title I core program participants (of Adult, Dislocated Worker, and Youth programs) served by each program of study on the state list of Eligible Training Providers (ETP list). The requirements for ETP reporting can be found at WIOA section 116(d)(4) and 116(d)(6)(B) and in the WIOA Joint and Department of Labor (DOL)-only final rules at 20 CFR 677.230 and 20 CFR 680.490.

Purpose: To inform States of the guidelines for the negotiation process for the WIOA title I programs (Adult, Dislocated Worker, and Youth) and the Wagner-Peyser Act Employment Service program, as amended by title III of WIOA, for PY 2018 and PY 2019. Once negotiated levels are agreed upon by each State and the U.S. Department of Labor (DOL), Employment and Training Administration (ETA), they will be incorporated into the State Unified or Combined Plan. This guidance also provides information on the negotiations process for the Adult Education and Family Literacy Act programs under title II of WIOA and the Vocational Rehabilitation program as amended by title IV of WIOA for PY 2018 and PY 2019.

Purpose: The U.S. Departments of Labor (DOL) and Education (ED) (collectively, Departments) are exercising their transition authority under section 503(a) of the Workforce Innovation and Opportunity Act (WIOA) to inform States that the Departments will consider Program Year (PY) 2016 WIOA Statewide and Local Performance Reports (form ETA-9169) submitted by October 16, 2017, as being timely. For all subsequent PYs, States must submit the WIOA Statewide and Local Performance Report by October 1 to be considered timely, pursuant to the "Workforce Innovation and Opportunity Act (WIOA) Performance Accountability, Information and Reporting System" information collection request (WIOA Joint Performance ICR).

Subject: Implementation of an Integrated Performance Reporting System for Multiple Employment and Training Administration (ETA) and Veterans' Employment and Training Service (VETS) Administered Programs
Purpose: The purpose of this Training and Employment Notice (TEN) is to announce the implementation schedule for an integrated performance reporting system for ETA and VETS workforce programs. Grantees under the Workforce Innovation and Opportunity Act (WIOA) (titles I and III), Trade Adjustment Assistance (TAA), H-1B Job Training Grants, Reentry Employment Opportunities (REO), and Jobs for Veterans State Grants (JVSG) will report performance measure outcomes under a new integrated system that will generally become available after July 1, 2016 for testing, and after October 1, 2016 for reporting. This TEN provides, for each program, a timeline for system availability and expected submission of performance data.
