Forms for Agricultural Recruitment System of Services to Migratory Workers and Employers

  1. Purpose. To alert State Public Employment Service Agencies that the Office of the Management and Budget (OMB) has extended the approval to use subject forms.

  2. Background. The Wagner-Peyser Act of June 6, 1993, as amended by JTPA (P.L. 97-3000) 29 U.S.C.49, et seq. requires each State agency to provide for an intrastate and interstate clearance recruitment and movement of workers. The Migrant and Seasonal Farmworker regulations at 20 CFR 653.500 established procedures for.agricultural clearance order activity. Federal regulations at 20 CFR.653.501(f)(1) require all local offices to use the interstate clearance form prescribed by ETA. The Agricultural Recruitment System is a coordinated service to migratory agricultural workers and employers.

  3. Use of ETA Forms. The forms are used as follows:

    1. The ETA-790 Agricultural Food Processing Clearance order is used to extend orders for work beyond the local office area and is sent to other States to maximize the exposure of job openings to the greatest number of potential workers.

    2. The ETA-795 Agricultural and Food Processing Clearance Memorandum is used by States and local offices to transmit the order, to request additional information and to provide changes and other actions on the clearance order.

    3. The ETA-785 Migrant Worker Itinerary indicates the preseason scheduling of migratory farmworkers to series of successive jobs in agriculture and related industries. This form also provides information on the crew, such as number of workers, non workers, unattached males and females. Local offices use this form to develop job openings, confirm commitments, and to refer workers to suitable openings.

    4. The ETA-785A Manifest Record is used to list names, addresses, social security number, and applicant characteristics of each member of the crew. It is used in conjunction with the ETA-785 Migrant Worker Itinerary form.

  4. OMB Approval. Approval of the above forms has been extended by OMB according to the Paperwork Act of 1995 under OMB Approval No. 1205-0134 to expire 7/31/98. This is a short term extension approval for subject .ETA forms.

    NOTE: Persons are not required to respond to this collection of information unless it-displays a currently valid OMB control number.
