Alien Labor Certification Program Questions and Answers

  1. Purpose. To transmit responses to outstanding questions from the 1994 National State Training Symposium held in San Francisco, California.

  2. References. 20 CFR 656, Technical Assistance Guide No. 656, and GAL 4 -95

  3. Background. The National Training Symposium for State Agency staff, held November 14-17, 1994, in San Francisco, California fostered closer communications and partnership between State and Federal staff administering alien labor programs. Although many questions were raised and answered during the general sessions and workshops, there were a number of program issues remaining which required further clarification or needed to be revisited based, on input from States. Participants were invited to leave written questions with National and Regional staff. This resulted in more than 200 questions relating to case processing and prevailing wage procedures. While the launching of our Reengineering Project around these two critical program areas prevented us from meeting our commitment to provide responses by January 30, the delay has permitted us to incorporate recent policy changes into the answers.

    The attached finalized Qs & As represent substantial effort on the part of a team of National , Regional , and selected State staff to formulate accurate and workable responses. Duplicative and/or similar questions were consolidated resulting in significantly fewer Qs & As in this final document. Several administrative issues relating to funding and reporting were left out of this policy guidance and will be handled by individual Certifying Officers within each region.

  4. Action Required. State Administrators are requested to provide the attached Qs and As to all State staff involved in-administering nonagricultural alien labor certification programs.

  5. Inquiries. Questions should be directed to the appropriate Regional Certifying Officer.
