A now-defunct Franklin, Tenn., company and its corporate president have agreed to pay the company’s 401(k) plan $38,0390.98, representing employee contributions which were not forwarded to the plan, as settlement of a U.S. Department of Labor lawsuit.

Labor Department Sues Erickson Cosmetic Executives For Self Dealing Of Pension Plan Assets And Unpaid Medical Claims

The U.S. Department of Labor sued Erickson Cosmetics Company, its former president and controller for self-dealing violations of the federal pension law, which resulted in losses to the pension plan and unpaid medical claims for benefit plan participants and beneficiaries.

The pension plan had 87 participants and assets of $773,097 as of Nov. 30, 2000.

Today the U.S. Department of Labor is issuing final rules that would implement provisions of the Child Support Performance and Incentive Act of 1998 that are intended to help children gain access to coverage under their noncustodial parents' employer-based group health plans. This regulation is effective 30 days from today's publication in The Federal Register, which is Jan. 26, 2001.
