U.S. Labor Department obtains default judgment against former employee leasing company in Brentwood, Tennessee, to protect workers’ 401(k) assets

Nashville, Tennessee – A federal court in Nashville has issued a default judgment order against Midland Employer Services of Brentwood, Tennessee, to protect 401(k) assets owned by workers at the defunct employee leasing company.

The order, issued by the U.S. District Court for the Middle District of Tennessee, removes the defendant from service as fiduciary of the plan and appoints Jeanne Barnes Bryant as an independent fiduciary with responsibility to terminate the plan and distribute its assets to eligible plan participants.

SEASONALLY ADJUSTED DATA In the week ending April 17, the advance figure for seasonally adjusted initial claims was 456,000, a decrease of 24,000 from the previous week's revised figure of 480,000. The 4-week moving average was 460,250, an increase of 2,750 from the previous week's revised average of 457,500.

The advance seasonally adjusted insured unemployment rate was 3.6 percent for the week ending April 10, a decrease of 0.1 percentage point from the prior week's revised rate of 3.7 percent.

MSHA launches inspection blitz in nations coalfields

US Department of Labor secures nearly $4 million in back wages for gas station employees in Central and Southern NJ

PISCATAWAY, N.J.The U.S. Department of Labor has obtained a judgment against Raceway Petroleum and Nicholas Kambitsis to pay $3.9 million in unpaid overtime wages and liquidated damages to more than 700 of their former and current employees, predominantly gas attendants. Raceway Petroleum Inc., a Piscataway company with gas stations located throughout Central and Southern N.J., along with its owner Nicholas Kambitsis, will also pay $100,000 in civil money penalties.

Defunct Oklahoma business and owner sued by U.S. Department of Labor over misuse of 401(k) contributions and loan repayments

Tulsa, Oklahoma – The U.S. Department of Labor has sued defunct Aircraft Fueling Systems Inc. of Tulsa and its owner for improperly using for the benefit of the company employee contributions and loan repayments owed to the plan.

Independent team of occupational safety experts to examine MSHAs internal review following explosion at Upper Big Branch Mine
