U.S. Labor Department Action Helps Hurricane Victims Access 401(k) Plans

Washington, DC - Today the U.S. Department of Labor’s Employee Benefits Security Administration (EBSA), along with the Internal Revenue Service (IRS), announced guidance for employers and plan officials to help victims of Hurricane Katrina obtain distributions and loans through 401(k) and similar employer-sponsored plans.

Labor Department Action Secures Distribution of 401(k) Benefits to Abandoned Piscataway Plan Participants

Piscataway, New Jersey - Jacqueline M. Carmichael has been appointed independent fiduciary of the NP LLC 401(k) plan to distribute benefits to plan participants, according to a court order obtained by the U.S. Department of Labor.

The action comes as a result of a suit filed by the U.S. Department of Labor alleging that plan trustees John Brewer and Dr. B. Gopinath abandoned the plan after Network Programs LLC declared bankruptcy in 1999.

(LGS) cannot discharge his debt of $167,530, plus lost opportunity costs, owed to the company’s 401(k) plan for unpaid contributions and loan repayments. Steven H. Urie owns the software development company.

Lansdale, Pennsylvania - The U.S. Department of Labor has obtained a court order requiring David Valaika and Phoenix Technical Services Inc. to restore $56,988 to the defunct company’s 401(k) plan.

Mabel Capolongo, regional director of the department’s Employee Benefits Security Administration (EBSA) said, “We filed this case to ensure that the plan participants recoup the money they set aside for their retirement years.”

Monroe, Michigan Firm Agrees To Restore Delinquent Contributions to 401(k) Plan

Detroit, Michigan - The U.S. Department of Labor has recovered $12,378.60 in principle and interest for delinquent contributions owed to the Fox Berry Inc. 401(k) plan, resolving a suit filed in Federal District Court in Detroit against the Monroe, Mich., firm. In addition to the restitution, the court appointed an independent fiduciary to manage the assets of the retirement plan.

WASHINGTON—The U.S. Department of Labor (DOL) issued a final rule today that fully implements the Wage Determinations OnLine (WDOL) Internet Web site at www.wdol.gov. The new rule updates existing regulations to allow contracting agencies to request and obtain wage determinations through the online services provided by the Web site.

Labor Department Obtains Court Order Restoring Nearly $20,000 to Eagan, Minnesota 401(k) Plan

St. Paul, Minnesota - Former trustees of Eagan, Minnesota-based Online Data Incorporated 401(k) Profit Sharing Plan have been ordered to restore $19,978.98 in delinquent employee contributions and lost earnings to the plan. Labor Department to Strengthen Union Conflict-of-Interest Disclosure

WASHINGTON—The U.S. Department of Labor's Office of Labor-Management Standards (OLMS) will publish in Monday's Federal Register a Notice of Proposed Rulemaking to update the Form LM-30, required by the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA). The LM-30 disclosure form must be used by labor union officers and employees to report potential financial conflicts of interest.

Department of Labor Requests Information from the Public On Fiduciary Responsibility Guidelines

WASHINGTON—The Office of Labor-Management Standards (OLMS) will publish a Request for Information in Monday's Federal Register to solicit public comments on whether the Labor Department should issue guidelines on section 501(a) of the Labor-Management Reporting and Disclosure Act (LMRDA). Section 501 imposes a fiduciary obligation on officers, agents, shop stewards and other representatives of labor organizations.
