In the week ending September 29, the advance figure for seasonally adjusted initial claims was 207,000, a decrease of 8,000 from the previous week's revised level. The previous week's level was revised up by 1,000 from 214,000 to 215,000. The 4-week moving average was 207,000, an increase of 500 from the previous week's revised average. The previous week's average was revised up by 250 from 206,250 to 206,500.

U.S. Department of Labor Litigation Results in Atlanta Trust Company Paying $4.5 Million in Restitution to Employee Stock Ownership Plan

RALEIGH, NC – The U.S. District Court for the Eastern District of North Carolina has signed a consent judgment approving a settlement between the U.S. Department of Labor and Reliance Trust Co. Inc. involving the Tobacco Rag Processors Inc. Employee Stock Ownership Plan. The consent judgment requires Reliance Trust Co. Inc. – an Atlanta, Georgia, company – to pay $4,545,454 back to the plan within 30 days. Once the payment is made, the Department will assess a civil penalty of $454,545 against Reliance Trust Co. Inc.

ELKINS PARK, PA – The U.S. District Court for the Eastern District of Pennsylvania has ordered SM Choi Inc. – which operates four fast-food establishments in Elkins Park, Pennsylvania – to pay $93,146 in back wages and an equal amount in liquidated damages to 38 employees for willful violations of the Fair Labor Standards Act (FLSA). The Department also assessed the employer $26,121 in civil penalties.
