US Department of Labor recovers more than $106K in back wages for 105 Louisiana waste workers denied overtime

IV Waste LLC failed to pay the overtime premium for hours over 40 in a week

Employer name:                   IV Waste LLC

Investigation site:                730 South Pierce St.

                                                       New Orleans, LA 70119

Investigation findings: The U.S. Department of Labor’s Wage and Hour Division found IV Waste LLC denied overtime wages to 105 employees by paying some a daily rate for hours worked over 40 in a workweek, and by failing to include certain types of bonuses when calculating the regular pay rate for overtime purposes. The employer also did not keep accurate record of hours worked for all non-exempt employees. All of these actions are violations of the Fair Labor Standards Act.

Back wages recovered:         $106,672 in overtime back wages

Quote: “Employees in the waste collection industry provide critical services for businesses and residential customers. Without them, our communities would look and smell much different,” said Wage and Hour Division District Director Troy Mouton in New Orleans. “These essential workers perform hard manual labor, often in incredibly taxing weather conditions. They deserve every cent that they earn,” added Mouton. “Their employers must take the legal wage-related obligations seriously to prevent workers from being shortchanged of the wages they deserve.”
