US Department of Labor recovers more than $51K in back wages, liquidated damages for four workers after investigation at Paducah restaurant

Employer:                              Chong’s Restaurant

Investigation site:                  5136 Hinkleville Road, Paducah, Kentucky 42001

Investigation findings: U.S. Department of Labor Wage and Hour Division investigators found the employer failed to pay overtime to workers for hours worked over 40 in a workweek. They also determined Chong’s failed to pay the minimum wage for two non-exempt salaried workers. By doing so, the employer violated provisions of the Fair Labor Standards Act.

Back Wages Recovered: $25,650 in back wages, and an equal amount in liquated damages for four workers

Quote: “The outcome of this case and others like it provide much needed relief to vulnerable workers who depend on those wages to make ends meet,” said Wage and Hour Division District Director Karen Garnett-Civils in Louisville, Kentucky. “Even in circumstances in which business owners contract with payroll providers, they are still responsible for oversite of their workers’ hours and pay. We encourage employers and employees to contact us for assistance in understanding their responsibilities and rights under the law.”

Background: The U.S. Department of Labor’s Wage and Hour Division mission is to ensure employers pay workers their rightful wages and honor protections afforded them by law. Employers can get more information about their responsibilities online, including a fact sheet that outlines how business can apply Fair Labor Standards Act wage laws for employees of restaurants and fast-food businesses.
