US Dept of Labor secures injunctions ordering Jan Charles Gray, affiliated businesses to comply with the Fair Labor Standards Act

Employers: Jan Charles Gray, individually and Mount Rushmore Broadcasting, Inc., All American Inn - Glenrock, and American President Resorts.

Sites: Mount Rushmore Broadcasting, Inc., in Casper, Wyoming; All American Inn - Glenrock in Glenrock, Wyoming; and American President Resorts in Custer, South Dakota.

Investigation findings: The U.S. Department of Labor secured consent judgments and injunctions in Wyoming and South Dakota ordering Jan Charles Gray and his affiliated businesses to comply with the Fair Labor Standards Act and to pay $21,000 in back wages to 10 former employees in South Dakota and Wyoming. The courts ordered the employers to train managers and employees about their rights under the FLSA, pay in accordance with the minimum wage and overtime requirements of the law, maintain accurate records, and not retaliate against any employee who files a complaint with, or cooperates in an investigation by the Wage and Hour Division. The injunctions are permanent and apply to the businesses investigated, as well as to Gray, individually; the training provisions apply for three years, not only to the businesses investigated, but to any business in which Gray has an ownership interest of 50 percent or greater.

Resolution: Injunctions were secured against Gray individually, as well as his affiliated businesses. The employer has paid all the wages due and has signed consent judgments in the U.S. District Courts for the Districts of Wyoming and South Dakota.

"We are committed to securing lasting compliance with the labor laws we enforce, and we are pleased that the judges in these cases enjoined the defendants from further violations of the FLSA."
