WASHINGTON — The U.S. Department of Labor will host two town hall meetings on Tuesday, June 24, and Wednesday, June 25, in Moab, Utah, to provide the public with information about the Energy Employees Occupational Illness Compensation Program Act and the medical benefits available under the program. The EEOICPA provides compensation and medical benefits to workers who became ill as a result of working in the nuclear weapons and uranium mining industries.

OWCP News Release: Final rule announced allowing for digital X-rays in black lung claims by US Labor Department [04/17/2014]

WASHINGTON — The U.S. Department of Labor's Office of Workers' Compensation Programs today announced a final rule adopting standards for administering and interpreting digital radiographs for the Federal Black Lung Program. The new rule will enable physicians who perform diagnostic testing of miner-claimants to use more modern medical technology to conduct a complete pulmonary evaluation. The rule allows film and digital chest X-rays to be given equal importance in claims adjudication.

OWCP News Release: US Department of Labor publishes final rule implementing the Byrd Amendments to Black Lung Benefits Act [09/25/2013]

WASHINGTON — The U.S. Department of Labor's Office of Workers' Compensation Programs today announced the final rule implementing amendments to the Black Lung Benefits Act passed by Congress in 2010. Commonly called the Byrd Amendments after their sponsor, the late Senator Robert C. Byrd, the amendments re-instate two provisions regarding coal miners' and survivors' entitlement to benefits that had been eliminated in 1981.

US Department of Labor reaches settlement with contractor on failure to report injuries and fatalities under Defense Base Act

WASHINGTON — The U.S. Department of Labor's Office of Workers' Compensation Programs today announced a $75,000 settlement with The Sandi Group/Corporate Bank Financial Services for failure to report in a timely manner on the injuries and deaths of 30 employees in Iraq between 2003 and 2005.

US Labor Department announces proposed rules implementing amendments to Black Lung Benefits Act from the Patient Protection and Affordable Care Act

WASHINGTON — The U.S. Department of Labor's Office of Workers' Compensation Programs has issued a proposed rule implementing amendments to the Black Lung Benefits Act that were enacted in Section 1556 of the Patient Protection and Affordable Care Act of 2010. The PPACA reinstates two provisions regarding coal miners' and survivors' entitlement to benefits that had been eliminated by 1981 amendments to the BLBA.

Federal appeals court upholds survivors right to automatic benefits under Black Lung Benefits Act

WASHINGTON — The U.S. Department of Labor's Office of Workers' Compensation Programs has successfully defended a recent amendment to the Black Lung Benefits Act contained in the Patient Protection and Affordable Care Act. The U.S. Court of Appeals for the 3rd Circuit held in "B & G Construction Co. v. Campbell and Director, Office of Workers' Comp. Programs" that the amendment is constitutional and provides benefits to certain survivors of miners who were entitled to benefits at the time of their deaths.

US Labor Department recognizes 10th anniversary of administering Energy Employees Occupational Illness Compensation Program Act

WASHINGTON — On July 31, the U.S. Department of Labor marked the 10th anniversary of administering the Energy Employees Occupational Illness Compensation Program Act. The EEOICPA provides compensation and medical benefits to eligible workers and their survivors who became ill as a result of working in the nuclear weapons industry. The department has administered Part B of the EEOICPA since the program's inception in 2001, and was charged with the implementation of Part E, created by an amendment to the EEOICPA, on Oct. 28, 2004.
