MSHA issues proposed rule on pattern of violations

Rule would eliminate potential POV notification and use of final orders in review

ARLINGTON, Va. The U.S. Department of Labor's Mine Safety and Health Administration today announced that a proposed rule to revise its pattern of violations regulation in 30 Code of Federal Regulations Part 104 will be published in the Federal Register on Feb. 2.The proposal, which would revise and simplify the POV criteria and MSHA's procedures for issuing a POV notice, is available at http://s.dol.gov/CQ.

MSHA announces results of December 2010 impact and regularly scheduled inspections

WASHINGTON The U.S. Department of Labor's Mine Safety and Health Administration today announced that federal inspectors issued 288 citations, orders and safeguards during special impact inspections conducted at 13 coal and 4 metal/nonmetal mine operations last month. The coal mines were issued 170 citations, 15 orders and one safeguard; the metal/nonmetal mines were issued 90 citations and 12 orders.

Mining deaths rise in 2010

MSHA chief pledges continued enforcement, outreach on behalf of nations miners

ARLINGTON, Va.Mining fatalities in the United States significantly increased in 2010, following a year marked by the fewest deaths in mining history, according to the U.S. Department of Labor's Mine Safety and Health Administration. Seventy-one miners died on the job last year, compared to 34 in 2009. Forty-eight of those deaths occurred in coal mines, and 23 occurred at metal and nonmetal operations.

ARLINGTON, Va. – The U.S. Department of Labor's Mine Safety and Health Administration today announced it has reached a settlement agreement with Farrell-Cooper Mining Co. in the 2007 death of an employee at its Rock Island Mine in Le Flore County, Okla. Farrell-Cooper has agreed to pay penalties totaling $375,204 for seven citations issued in the wake of the fatality, including three flagrant violations.

MSHA puts 13 mines on notice for potential pattern of violations -

ARLINGTON, Va. – The U.S. Department of Labor's Mine Safety and Health Administration announced today that 13 mines from around the country received letters putting them on notice that each has a potential pattern of violations of mandatory health or safety standards under Section 104(e) of the federal Mine Safety and Health Act of 1977. These are the first mining operations to receive such notification since MSHA implemented major reforms to its POV process, including tougher provisions for mines with chronic and persistent health and safety violations.

MSHA launches 2nd phase of Rules to Live By enforcement initiative

ARLINGTON, Va. – The U.S. Department of Labor's Mine Safety and Health Administration today launched the second phase of an outreach and enforcement program designed to strengthen efforts to prevent mining fatalities. "Rules to Live By II: Preventing Catastrophic Accidents" was developed from data gathered by reviewing accidents that resulted in five or more fatalities, as well as from incidents caused by fires or explosions that had the potential to result in more fatalities.
