ILAB Press Release: Labor Department Recommends Ministerial Consultations On Enforcement Of Mexican Labor Laws At TAESA [07/10/2000]

Labor Department's National Administrative Office (NAO) has recommended ministerial consultations as a result of its review of a submission raising issues with respect to enforcement of Mexican labor laws at Executive Air Transport, Inc., known as TAESA. The submission was filed under the North American Agreement on Labor Cooperation, the labor agreement related to NAFTA.

The Association of Flight Attendants and the Association of Flight Attendants of Mexico filed the submission. They alleged that Mexico did not enforce its labor laws when flight attendants tried to gain representation rights for a union at TAESA, a Mexican airline with service to the United States. They also claimed that Mexico failed to enforce its laws regarding overtime and mandatory payroll tax contributions for social security, pensions and housing. Furthermore, the submitters asserted that Mexico did not enforce its laws concerning flight attendant training and occupational safety and health aboard TAESA aircraft.

The NAO recommends that Secretary Alexis M. Herman consult with Mexican Secretary of Labor and Social Welfare Mariano Palacios on the issues raised in the submission. These include: legal provisions for a union to seek representation of workers in its craft where a company-wide collective labor agreement already exists; Mexican law on conducting union representation elections and the role of Conciliation and Arbitration Board officials; and overtime, payroll deduction and occupational safety and health requirements.
