Washington, DC - U.S. Secretary of Labor Elaine L. Chao today announced a proposed rule to make it easier for fiduciaries of 401(k) plans and other participant-directed defined-contribution plans to adopt automatic enrollment design features. The proposed rule is the first major regulation resulting from the Pension Protection Act signed into law by President Bush on August 17, 2006.

Columbus, Ohio - The U.S. Department of Labor has sued Team America Corporation, Columbus, Ohio and three individuals who served as fiduciaries to the company’s retirement savings, health and disability programs for failing to forward employee and employer contributions to the plans and to segregate plan contributions from the general operating assets of the company.

West Middlesex, Pennsylvania - The U.S Labor Department has sued Coast to Coast Home Equity Corp. to obtain appointment of an independent fiduciary to distribute the assets of the company’s 401(k) plan to plan participants. The defunct West Middlesex, Pennsylvania company is currently in bankruptcy and ceased operations in May 2004.

Philadelphia, Pennsylvania - The U.S. Department of Labor sued Javis Automation & Engineering, Inc., Dumfries, Virginia, and its president, John W. Long, Sr., for failure to remit contributions deducted from employees’ paychecks to the company’s 401(k) profit sharing plan.

Burlington, New Jersey - The U.S. Labor Department sued Russell Johnson and Shellene Barker, trustees of the Johnson Specialized Transportation, Inc. 401(k) Plan, for allegedly failing to forward more than $36,000 in employee and matching employer plan contributions plus lost opportunity costs to the plan.

Villa, the owners of Villa Automotive and Villa Service Center of San Luis Obispo, California, for failing to forward employee contributions to the Villa Automotive 401(k) employee pension benefit plan. Washington, DC - The U.S. Department of Labor today announced an agreement with the estate of Kenneth L. Lay granting a $12 million claim against his estate on behalf of participants covered by Enron's pension plans. Lay died on July 5, 2006. This proposed settlement must be formally documented and submitted for approval to the U.S. District Court for the Southern District of Texas.

Denver, Colorado - The former owners of Vancol Industries Inc. of Denver must pay more than $150,000 to the company’s profit sharing plan as restitution for improper loans made from the plan to the company’s owners, plan participants and affiliated companies, according to a consent judgment obtained by the U.S. Department of Labor.
