Boston, Massachusetts - Trustees of the Rhode Island Laborers' Legal Services Plan have agreed to restore $318,181 to the plan to settle a lawsuit filed by the U.S. Department of Labor for alleged violations of the Employee Retirement Income Security Act (ERISA), the federal law that protects private sector employee benefit plans.

Washington, DC - The U.S. Department of Labor has sued the trustees of two union-sponsored health plans in Colorado for imprudently investing plan assets in investments with Capital Consultants LLC (CCL). The department contends the investments caused the plans to suffer substantial losses that jeopardized the benefits of more than 2,700 workers.

Atlanta, Georgia - The former owner of Complete Health System, Inc. of Vicksburg, Mississippi, (formerly Haworth Home Health Agency, Inc.) was sentenced on January 23, 2004 to four months in prison, four months of home confinement, probation and restitution to the company’s 401(k) plan.

Houston, Texas - Houston-based Easy Does It, Inc. and its owners have been sued by the U.S. Department of Labor for failing to properly manage the company’s profit sharing plan and failing to distribute plan assets to more than 20 participants. Easy Does It, Inc. provided alcohol and drug abuse treatment services.

Cleveland, Ohio - The U.S. Department of Labor has obtained a consent order and judgment requiring the trustee of the health plan of Lake County, Ohio-based E & W Services, Inc., to repay $31,336 directly to participants as restitution for failure to forward employees’ premiums and payments for health benefit coverage.

New York, New York - The U.S. Department of Labor sued to remove the plan trustee and appoint an independent fiduciary for the Oven Digital, Inc. 401(k) plan of New York, New York after the plan was abandoned by the plan’s fiduciary. The independent fiduciary will be responsible for distributing plan assets to participants and terminating the plan.

Chicago, Illinois - Under a consent judgment obtained by the U.S. Department of Labor, the owner and chief executive officer of Relco Locomotives, Inc., was removed as a fiduciary of the company’s 401(k) plan because he failed to forward employee contributions to the plan in a timely manner.
