U.S. Labor Department seeks to restore employee contributions owed to Missouri SIMPLE IRA plan

Kansas City, Missouri – The U.S. Department of Labor has filed a lawsuit against Ronald Unterreiner, the president, secretary and director of Design and Construction Services Inc., in Chesterfield, Missouri, which sponsored the Design and Construction Services Inc. SIMPLE IRA Plan, for failure to forward $10,351.34 in employee contributions to the plan.
The suit alleges that Unterreiner violated the Employee Retirement Income Security Act (ERISA) by failing to forward any employee contributions to the plan for 2005. It also requests a court order to permanently enjoin Unterreiner from violating the provisions of Title I of ERISA and to restore all losses to the plan and participants.
“The Labor Department is committed to helping workers get their benefits when plan assets are either misused or the plans are abandoned,” said Steve Eischen, director of the department’s Employee Benefits Security Administration (EBSA) Kansas City Regional Office.
The suit, filed in the U.S. District Court for the Eastern District of Missouri, resulted from an investigation conducted by EBSA’s Kansas City office.
