What/Who is a class member?
Have you applied for a job or worked at one of the facilities listed in the table during the time period shown? If the answer is yes, then you may be a class member in an OFCCP investigation and you may be entitled to money and/or consideration for a job. Contact us immediately as the deadline to submit important documentation to verify your eligibility will soon end.

For each case, information about the issues can be found in the case summary, Conciliation Agreement and press release, if applicable.

For each case in the Class Member Locator table, there is a "Contact Us" link in the far right hand column under the header "Learn More." The link is unique to that specific case. If you believe that you are part of a class in one of the cases, please click on the "Contact Us" link to email OFCCP.

You can expect to hear back from OFCCP, via phone or email, within 10 business days. Please be sure to check your spam mail, and add OFCCP’s email address to the list of approved email addresses in your contacts.
I believe I am part of a class in one of the cases, but the deadline has passed. What should I do?
The notice process is time sensitive. If you fail to return the required documents by the deadline or if your documents do not verify your eligibility you will not be eligible to receive any money or any other relief provided by the settlement. If you believe there has been some error in receiving the documents, or if you did return them on time but did not receive any response, please use the "Contact Us" link related to the case to send an email explaining the situation. Please note that these requests will be handled on a case by case basis and that there is no guarantee you will be able to participate in the settlement if the deadline has passed.
I believe I am part of a class in one of the cases, but I did not apply for or work in the job listed on the Class Member Locator. What should I do?
There are instances in which a company may consider applicants for multiple jobs. In this case, it’s possible that you applied for one job but were considered for another. If I contact OFCCP before the deadline, am I automatically part of the class?
No. In most cases, OFCCP has a list of class members that it is looking to locate and/or some specific eligibility criteria. If OFCCP confirms that you are on the list or meet the criteria, then OFCCP will send you additional documents to complete and submit by a specified deadline. If your documents are in order, verify your eligibility and are received by the deadline, then you will be considered part of the class.
How much money can I expect to receive as a result of being part of a class?
Monetary relief varies by case – it may be hundreds or thousands of dollars. If you submit documents and OFCCP can verify your eligibility as a member of the class, you will be notified of the amount you are eligible to receive.
Am I guaranteed employment with the contractor if I submit my information on time?
No. For starters, not every case has job opportunities associated with it. If there are job opportunities, then the contractor will make job offers to class members who have completed and timely returned the notice documents, have expressed interest in employment, and are not currently employed with the contractor, as vacancies occur, until a select number of class members are hired or the list of class members is exhausted, whichever comes first.
I received something in the mail about the case. If I contacted OFCCP through the Class Member Locator, do I still need to complete the paperwork I received in the mail?
Yes. Contacting OFCCP is only the first step. It is extremely important that you complete the paperwork and submit it by the specified deadline in order to be considered part of the class. If you have questions, please contact your local OFCCP office identified on the paperwork.
I received notification that I am entitled to a portion of monetary relief. Do I have to pay taxes on this money?
Usually the contractor will withhold taxes on settlement amounts that represent lost wages, and will send you a W-2 showing the amounts paid. Sometimes your settlement will include an amount for interest and you will get a 1099 tax form for that amount and will need to include it in your tax return. If you have questions about taxes, you can access information at irs.gov.
I received some documents in the mail. How can I verify they are legitimate?
You will receive three documents: a general overview document that explains the settlement and next steps, a claim form, and a release of claims. You must complete and return the claim form and release of claims document by the specified deadline in order to be eligible to a payment and/or job offer. If you have questions or want to verify the information provided, contact the respective OFCCP office that appears on the documents.
Can I contact OFCCP through the Class Member Locator on behalf of a worker?
Yes. You may click on the "Contact Us" link related to a case and email OFCCP on behalf of a worker(s). Please double check the contact information you provide us because OFCCP must be able to reach and follow up with the individual(s) in order for them to share in any settlement. Please click on the "Contact Us" link related to the case and email your questions to OFCCP. The regional or district office may be planning an information session in your local area for potential class members to learn about the case, their rights, and immediate next steps. Your assistance is appreciated in spreading the word about the session to help make sure applicants/workers know about the case settlement.
I want to learn more about OFCCP’s conciliation process so that I can educate my stakeholders. What should I know and where can I find additional information?
OFCCP is the government agency responsible for enforcing the non-discrimination and affirmative action requirements that apply to certain federal contractors. OFCCP conducted a review of the employment practices of the contractor establishments listed in the Class Member Locator during a specified time period. OFCCP issued a notice alleging that the contractors discriminated against a specified group or groups in their employment practices during the stated time period. In each case, although the contractor involved denies those claims, OFCCP and the contractors have agreed to resolve the issue through a Conciliation Agreement. A Conciliation Agreement is a legal document that explains the terms of an agreement to settle the alleged violations set out in the notice issued by OFCCP. The conciliation agreement, press release, and notice documents explain what transpired in OFCCP’s investigation, as well as the next steps. Yes. The purpose of the Class Member Locator is to locate as many class members as possible by directing potential class members to contact OFCCP. However, you are still responsible for any tasks like sending notice or providing information that are set forth in your agreement.
My company is in the process of negotiating a Conciliation Agreement. Can we negotiate for our company not to appear in the Class Member Locator?
No. OFCCP makes its Conciliation Agreements involving financial remedies for discrimination available online in the Department of Labor’s FOIA Reading Room. In addition, the Class Member Locator supports efforts to locate as many class members as possible.
